The fight over who counts in America came to a head on Friday, October 30, 2026, as rival camps in the House of Representatives fired off duelling letters about the 2030 census apportionment — one demanding that only United States citizens count toward congressional seats, the other warning that excluding non-citizens would violate the Constitution. With the public comment period closing on Monday, November 2, the 2030 census apportionment battle has become the latest front in the struggle over representation, redistricting and the balance of power in Washington.

Key Points

• Representative Mary Miller of Illinois led 44 House Republicans in a letter on Friday urging Commerce Secretary Howard Lutnick to base congressional apportionment and Electoral College votes solely on US citizens.
• The Republican letter goes further than the Census Bureau's own proposal, urging that even lawful permanent residents — green-card holders — be excluded from the apportionment count.
• More than 150 House Democrats, led by Representative Robert Garcia, demanded the administration withdraw the proposed rule, arguing it would violate the 14th Amendment's requirement that representation reflect the number of people in each state.
• Under the bureau's proposal, green-card holders would still count, but undocumented immigrants and non-citizens with less permanent status — including temporary visa holders — would not.
• The National Conference of State Legislatures asked for a further 60 days for public responses and consultation with states before the rule moves forward.

What Happened

On October 30, Representative Mary Miller, a Republican from Illinois, led 44 House Republicans in a letter to Commerce Secretary Howard Lutnick endorsing the Census Bureau's proposed 2030 rule changes — and pressing the administration to go further. The letter urges that congressional apportionment and Electoral College votes be based solely on US citizens. Miller's group argued that congressional representation should be determined by American citizens, and it also sought restrictions on demographic questions in the American Community Survey, extending beyond the bureau's proposal.

The same day, the other side of the aisle answered. Five Indian-American lawmakers — Pramila Jayapal, Ro Khanna, Raja Krishnamoorthi, Suhas Subramanyam and Shri Thanedar — joined more than 150 House Democrats in demanding that the Trump administration withdraw the proposed census rule that would exclude some non-citizens from the population used to allocate congressional seats. The effort was led by Robert Garcia, the top Democrat on the House Oversight and Government Reform Committee, together with the chairs of the Asian Pacific American, Hispanic, Black and Equality caucuses, according to the Congressional Asian Pacific American Caucus.

The Democratic lawmakers argued that the proposal would violate the 14th Amendment's requirement that representation reflect the number of people in each state. Separately, the National Conference of State Legislatures, in comments published Friday, sought a further 60 days for public responses and consultation with states over the changes.

Background: How Apportionment Works

The United States conducts a census every 10 years, and its population figures are used to divide the House of Representatives' 435 seats among the 50 states. Electoral College votes track those seats, plus two senators per state, and federal grant formulas often use the same population base to steer trillions of dollars in aid for education, health care and food assistance.

Under long-standing practice, the Census Bureau has included unauthorised immigrants in the resident population figures used for apportionment. The 2020 census included all residents in the enumeration for apportionment, including US citizens, temporary visa holders, foreign nationals and people living in the country illegally.

The current fight began last summer, when President Donald Trump ordered the Commerce Department to exclude people living in the country illegally from the 2030 count. In a social media post, Trump wrote: "People in our Country illegally will not be counted in the census." The Commerce Department then published its proposed rule in September. An October 5 notice extended the public comment deadline from October 13 to November 2.

There is also a constitutional wrinkle the administration itself has acknowledged. Commerce Secretary Howard Lutnick, who oversees the Census Bureau, has acknowledged that Congress, not the president, has the final say over the national head count used to reshape election maps and guide federal funding. Speaking at a town-hall event for bureau employees, Lutnick suggested that when tallying the population, the census should differentiate people living in the US without legal status from other residents.

2030 Census Apportionment: What the Proposed Rule Would Change

The proposed regulations centre on two issues: residence criteria and demographic questions. At their heart is a new definition of "usual residence" — the residence at which a person has lawfully spent the greatest number of days during the census enumeration period, which runs from January 3 to April 1.

Under that definition, foreign citizens who are also US citizens or lawful permanent residents would be counted. Foreign citizens who are not US citizens or lawful permanent residents would not be counted — a group that covers people on student visas, Temporary Protected Status, asylum claims, or as refugees, as well as people living in the country illegally. Military or civilian employees stationed outside the US, and their dependents, would be counted, while US citizens living outside the US who are not military or civilian employees would not.

The bureau argues that lasting residence and allegiance to the United States should determine who is counted for apportionment. The agency is considering administrative records to establish individuals' legal status, and it is seeking comments on whether to add a legal-status question to the census form.

On demographic questions, the proposed rule would bar questions about race, ethnicity and sexual orientation on census questionnaires used to enumerate the population. Demographic questions have been asked on the US census in some form since 1790, and the administration has cited what it calls substantial doubts about the meaning, significance and impact of attempting to categorise people by race and ethnicity.

Miller's letter would go further on both fronts: excluding all non-citizens, including green-card holders, from congressional apportionment, and restricting demographic questions in the American Community Survey as well.

Reactions and Quotes

Miller's camp frames the issue as a matter of democratic legitimacy: representation in Congress, in their argument, should be determined by American citizens alone. The letter to Lutnick endorses the bureau's direction of travel and urges the administration not to stop halfway.

The Democratic response frames it as a constitutional red line. The 14th Amendment requires the "whole number of persons in each state" to be counted for apportionment, and the Garcia-led letter argues that stripping out whole categories of residents would breach that requirement. The five Indian-American signatories put the Congressional Asian Pacific American Caucus squarely behind that position, alongside the Hispanic, Black and Equality caucuses.

State legislatures, which would have to live with whatever maps follow a new count, are asking for more time. The National Conference of State Legislatures sought a further 60 days for public responses and consultation with states, a sign that even the process, not just the substance, is contested.

The bureau itself has defended the proposal on administrative grounds, arguing that lasting residence and allegiance should decide who counts, and pointing to administrative records as a way to establish legal status without relying solely on survey answers.

Why It Matters

Apportionment is the quiet machinery underneath American politics. Shifting who counts changes how many House seats each state gets, how many Electoral College votes it commands, and how much federal money flows to its schools, hospitals and food programmes. States with large immigrant populations — including states with many lawful permanent residents and temporary visa holders — would be most affected if the proposed rule, or Miller's stricter version, takes effect.

The timing sharpens the stakes. The midterm elections on Tuesday, November 3, will decide control of the House, and the census fight feeds directly into the wider battle over redistricting and representation that has already produced a rare mid-decade map-drawing push in several states. A rule that removes millions of people from the apportionment base would redraw the political map for the next decade, not just for one election cycle.

The legal stakes are equally high. The 14th Amendment's "whole number of persons" language has anchored the all-residents practice for generations, and the Democratic letter's constitutional challenge signals that any final rule will face a court fight. Lutnick's own acknowledgement that Congress has the final say adds a further hurdle: a rule imposed by the executive alone may not survive contact with the legislature or the courts.

What Happens Next

The immediate deadline is Monday, November 2, when the extended public comment period closes — unless the National Conference of State Legislatures gets its wish for a further 60 days. The bureau will then weigh the comments before finalising any rule, and the debate over a legal-status question on the census form will continue in parallel.

After that, expect two tracks: a legislative one, as House members on both sides press their case with the Commerce Department, and a legal one, as opponents prepare challenges grounded in the 14th Amendment. The 2030 census itself is still years from enumeration, but the fight over who counts in it is already shaping the maps, the money and the politics of the decade ahead.

Frequently Asked Questions

What is census apportionment? Apportionment is the process of dividing the House of Representatives' 435 seats among the 50 states based on population figures from the census. Electoral College votes follow the same distribution, plus two senators per state.

What does the proposed 2030 rule change? It would count only US citizens and lawful permanent residents for apportionment, excluding undocumented immigrants and non-citizens with temporary status, and it would bar race, ethnicity and sexual orientation questions from enumeration questionnaires.

How does Mary Miller's letter go further? Miller and 44 House Republicans urge that even green-card holders be excluded, so that apportionment and Electoral College votes are based solely on US citizens, and they seek demographic-question restrictions in the American Community Survey too.

Why do Democrats say it violates the Constitution? They argue the 14th Amendment requires representation to reflect the "whole number of persons in each state," so excluding categories of residents from the apportionment count would breach that requirement.

When is the decision due? The public comment period closes on November 2, 2026, though state legislatures have asked for a further 60 days. The bureau will review comments before any final rule, and legal challenges are expected.
