A Mahwah pool company and two of its employees have been indicted after a chemical mix-up at a fitness club in Middlesex County released toxic gas and injured six people, New Jersey prosecutors announced. The case turns on a basic safety rule that investigators say was broken twice over: hazardous pool chemicals were kept in unlabelled containers, and a delivery worker poured one chemical into the wrong container.

Key Points

• United Pools of New Jersey Inc., doing business as Arch Pool Management, was indicted over a July chemical incident at a North Brunswick fitness centre.
• The company faces a third-degree charge of risking widespread injuries, among other crimes, state Attorney General Jennifer Davenport announced on 29 October 2026.
• Two employees — a 45-year-old man from Clifton and a 53-year-old man from Willingboro Township — were also indicted and face similar charges.
• Prosecutors say sodium hypochlorite, the chlorine used in commercial pools, was poured into a container of muriatic acid, releasing toxic gas.
• Six people were injured in the incident; the fitness centre has not been named by authorities.

What Happened

According to documents unsealed in the case, one United Pools employee was maintaining hot tub and pool equipment at an undisclosed fitness centre in North Brunswick in July 2026. Prosecutors allege that the employee did not keep legally required labels on containers of liquid chemicals, including muriatic acid and sodium hypochlorite.

A second employee then delivered sodium hypochlorite — the chlorine compound used to sanitise commercial swimming pools — to the site. Contrary to his training, prosecutors say, he failed to check the container he was filling. The sodium hypochlorite was allegedly poured into a container holding muriatic acid, an acid used to lower the pH and total alkalinity of pool water.

Mixing a chlorine-based compound with an acid is a well-known hazard: it can release chlorine gas, which irritates the eyes, throat and lungs and can cause serious breathing difficulty in enclosed spaces. Prosecutors say that, as a result of the alleged reckless handling of the chemicals, toxic gas was released inside the facility and six people were injured.

Attorney General Jennifer Davenport announced the charges on 29 October 2026. The company, United Pools of New Jersey Inc., which trades as Arch Pool Management and is based in Mahwah, was accused of third-degree risking widespread injuries, among other crimes. The two employees were indicted on similar charges. Authorities have not published the employees' names in the reporting available, nor the exact condition of the six injured people, and the fitness centre involved has not been identified.

Background/Context

Pool chemistry is a routine but unforgiving part of running a gym, hotel or condominium pool. Sodium hypochlorite, commonly known as liquid chlorine or bleach, disinfects water by releasing chlorine. Muriatic acid, a diluted form of hydrochloric acid, is added in small, controlled amounts to bring pH down when water becomes too alkaline. Kept apart and handled with labelled containers, gloves and ventilation, both are standard pool supplies. Poured together, they react and can fill a plant room or pool hall with chlorine gas within minutes.

That is why labelling and container checks are not paperwork formalities. New Jersey, like other states, requires hazardous chemicals to be kept in properly labelled containers so that anyone handling them — including a delivery driver who did not fill the container originally — can see at a glance what is inside. Prosecutors frame the North Brunswick case as a failure of exactly that system: an unlabelled container, plus a delivery check that was not carried out.

United Pools states on its website that it has been in business for 23 years and has completed 360 construction projects. Besides pool maintenance, the company says it manages hundreds of lifeguards and offers clubhouse cleaning services for condominiums and hotels. The indictment does not allege that the company's wider operations were unsafe; the charges concern the specific chain of events at the North Brunswick fitness centre.

NJ Pool Company Indicted: What Prosecutors Allege

The attorney general's framing is blunt. "The conduct that resulted in these charges involved more than a simple mistake by one person," Davenport said. "We allege multiple failures that led to injuries. The law is in place to prevent incidents like this, and we will continue to enforce the law to keep people safe."

The language matters because it signals how the state intends to argue the case. A single slip by one worker might be framed as negligence; a missing label plus a skipped check, prosecutors suggest, is a pattern of failures that turned a manageable risk into six injuries. The charge of risking widespread injuries, a third-degree offence in New Jersey, is used where conduct is alleged to have recklessly created a risk of widespread injury or damage — a category that fits a toxic gas release inside a public facility.

It is important to be clear about what an indictment is. An indictment is a formal accusation, not a finding of guilt. The company and the two employees are presumed innocent unless proved guilty in court, and the case will now move through the New Jersey criminal process, where prosecutors must prove the allegations. No trial date or plea information was included in the reporting available.

Reactions/Quotes

Attorney General Jennifer Davenport, announcing the charges on 29 October, said: "The conduct that resulted in these charges involved more than a simple mistake by one person. We allege multiple failures that led to injuries. The law is in place to prevent incidents like this, and we will continue to enforce the law to keep people safe."

The case was investigated by detectives assigned to the regulatory crimes unit of the state Division of Criminal Justice, with assistance from the North Brunswick Police Department. Regulatory crimes detectives handle cases where licensed or regulated activity — including the handling of hazardous materials — is alleged to have broken safety law.

Why It Matters

Swimming pools and hot tubs are among the most common shared facilities in American life: gyms, schools, hotels, apartment blocks and municipal leisure centres all depend on the same two families of chemicals. Most days, nothing goes wrong, which is precisely why the safety rules exist — the system has to work on the tired day, the rushed delivery and the shift when the usual worker is absent.

The North Brunswick case is also a reminder that chemical safety failures rarely have a single cause. Safety investigators in industry and government repeatedly find the same pattern: a labelling shortcut, a check skipped, a container reused for a different chemical. Each step alone might not cause harm; together, they can. For pool operators, the lesson is unglamorous but concrete: label every container, verify every delivery, and never pour a chemical into a container whose contents have not been checked.

For the six people injured, the consequences are personal rather than procedural. Toxic gas exposure can cause coughing, eye and throat irritation and breathing difficulty, and in severe cases can require hospital treatment and follow-up care. Authorities have not disclosed the severity of their injuries, and this article will not speculate about them.

What Happens Next

The indicted company and employees will now face proceedings in New Jersey's criminal courts, where arraignment, discovery and pre-trial motions come first. Prosecutors may also face questions about the fitness centre's own role, since the facility has not been named and no charges against it have been reported. If the case proceeds to trial, the central questions will be whether the labelling and delivery failures happened as alleged, and whether they amounted to the recklessness the charges require.

Separately, the incident may draw attention from workplace-safety and public-health regulators, who can inspect pool plant rooms and require corrective steps even while a criminal case is pending. Pool operators across New Jersey will be watching: a prosecution of this kind tends to sharpen compliance checks well beyond the single company involved.
