Donald Trump has said he would protect Elon Musk and his White House aides with preemptive pardons if Democrats take control of Congress in Tuesday's midterm elections and then pursue investigations against them. Trump Musk pardons became the latest flashpoint of the election-eve campaign on Monday, November 2, 2026, when the president's remarks in a podcast interview were reported by USA Today, Axios and other outlets.

The pledge is conditional, not a pardon already signed. Trump was asked what he would do if a Democratic-controlled House investigated Musk, seized his assets or prosecuted members of his administration. He answered that he would act if he believed it was necessary, even though no formal charges against Musk were mentioned in the interview reports. The comment lands one day before voters decide all 435 House seats and 35 Senate seats, with polls pointing to a strong Democratic chance of winning the House.

Key Points

• Trump said he would issue preemptive pardons to Elon Musk and other White House aides if Democrats win Congress and pursue investigations.
• The remarks came in the New York Post's "Pod Force One" podcast with host Miranda Devine, published on Monday, November 2, 2026.
• Trump dismissed talk of Democrats arresting Musk or seizing his assets as "talk", but added: "If it is talk, we'll have to protect them."
• Asked directly about pardons, he said: "I would if I needed to, sure. I wouldn't even think about it. I did it for J6."
• He pointed to former President Joe Biden's preemptive pardons in January 2025 as a precedent for acting before any charge is brought.
• No pardon has been issued under this pledge, and presidential pardons cover federal offences only, not state cases, civil lawsuits or impeachment.

What Happened

According to USA Today's report of the interview, Trump vowed to protect Musk, described as the world's richest man and a close ally, and said he would consider pardoning him and other potential targets of Democratic investigations even if they had not been formally charged. The podcast interview aired on November 2, the day before the midterms, when Democrats are strong favourites to take the House and gain control of its investigative committees.

Devine pressed Trump on rumours circulating on the left that Democrats might investigate Musk, go after his companies or even try to seize his assets. Trump first played down the prospect. "It won't happen. It's talk," he said, according to reports of the exchange. He then added the sentence that has driven the coverage since: "But if it is talk, we'll have to protect them."

When the conversation turned specifically to whether that protection could include a preventive pardon, Trump did not hesitate. "I would if I needed to, sure," he said. "I wouldn't even think about it." Asked whether the offer would extend to everyone who had worked for him, he repeated the point in blunter terms: "I'd do it. I did it for J6."

Reports of the interview also say Trump named Edward Coristine, who worked on Musk's Department of Government Efficiency project, as one of the aides he would protect. He dismissed suggestions that Democrats might try to nationalise SpaceX, Musk's rocket company, while making clear that he would defend Musk and his team against congressional investigators if they became targets.

Background and Context

Musk's political role in the second Trump administration is the reason the question arose at all. He led the Department of Government Efficiency, the government-slashing drive that sought deep cuts to federal programmes and staffing in the early months of Trump's second term. Democrats have signalled they could investigate that work if they win the House: how the department operated, what access its staff had to government systems, and how its decisions affected federal workers and services.

Two other lines of inquiry have also been raised by Democrats and their allies. One concerns Musk's companies and their lucrative federal contracts, including SpaceX's work for the government. The other concerns Starlink, the satellite internet service operated by SpaceX, and Musk's potential role in decisions affecting Ukraine's access to it during the war. None of those lines, as reported on Monday, amounts to a criminal charge against Musk, and the interview itself was framed around hypothetical Democratic investigations rather than any pending prosecution.

Musk's money is a second part of the backdrop. USA Today, citing the New York Times, reported that Musk spent nearly $290 million to help Trump in the 2024 election and has poured $474 million into boosting Republicans in the 2026 midterm cycle. That includes $212 million to help Ken Paxton, the Republican Senate nominee in Texas. The scale of that spending has made Musk one of the most consequential political donors of the cycle, and a natural focus for Democratic criticism.

The timing matters too. The interview is the same "Pod Force One" conversation in which Trump told Devine he would become "Mr Veto" if Democrats won Congress, a remark covered separately on US News Pulse. Together, the two sets of comments sketch Trump's closing argument for the final day of the campaign: if Democrats win, he will block their legislation with vetoes and shield his allies with pardons. The Lincoln Memorial Reflecting Pool speech scheduled for Monday afternoon was expected to carry the same closing message to voters in person.

Trump Musk Pardons

Trump's own justification for the pledge was precedent. "That's what Biden did. He gave everybody a pardon," he said, referring to the preemptive pardons issued by former President Joe Biden before he left office in January 2025. Biden's final-hours pardons shielded people he expected could face retaliation from the incoming administration, including former Representative Liz Cheney, Senator Adam Schiff and other members and staff of the House committee that investigated the January 6, 2021 attack on the Capitol.

Biden also pardoned Dr Anthony Fauci, retired General Mark Milley, the former chairman of the Joint Chiefs of Staff, and his son Hunter Biden and other family members. Those pardons were controversial at the time, and they have since become a reference point for both parties whenever a president promises to protect allies before any charge exists. Trump is now explicitly invoking that precedent, while his own record on pardons gives the promise a different weight.

In his second term, Trump has used the pardon power often. USA Today reported that he has granted clemency to more than 1,700 individuals, the vast majority of them people charged over the January 6, 2021 storming of the Capitol, an attack aimed at stopping certification of his 2020 election defeat. He has also pardoned dozens of business figures convicted of white-collar crimes. His reference to "J6" in the interview was a reminder of that record: on his first day back in office in January 2025, he pardoned around 1,500 defendants charged over January 6.

Legal experts note an important limit that the interview did not dwell on. A presidential pardon applies to federal offences. It cannot stop a state prosecution, block a civil lawsuit or prevent impeachment proceedings. That means a preemptive federal pardon, even if issued, would not end every form of legal or political scrutiny a future Congress or state prosecutor might pursue. It would, however, remove the threat of federal criminal prosecution for the conduct it covered, which is why the promise carries political force even before any pardon is signed.

Reactions and Quotes

The interview has been reported as a straightforward statement of intent, and the quotes themselves have done most of the work. "It's talk, but if it is talk, we'll have to protect them," Trump said when asked about House Democrats arresting Musk and seizing his assets. "I would if I needed to, sure. I wouldn't even think about it. I did it for J6," he said when asked whether he would issue preemptive pardons.

Former Labour Secretary Robert Reich has previously called for Democrats to lay the groundwork for nationalising SpaceX, according to reporting on the interview, and some commentators have suggested that Department of Government Efficiency staff, including Coristine, should face scrutiny. Those proposals remain arguments from outside government, not announced Democratic Party policy, and Trump treated them in the interview as part of a broader threat from a Democratic Congress rather than as a specific pending case.

Democrats have not, in the reports checked on Monday, issued a single coordinated response to the pardon pledge itself. That is consistent with the final day of a campaign in which the party's closing message has focused on the cost of living, health care and the war with Iran, rather than on Musk personally. The pardon remark may nevertheless become a campaign talking point in the final hours, because it ties together two themes Democrats have used against Trump: his closeness to billionaire donors and his willingness to use presidential power to protect allies.

Republicans, for their part, have framed the midterms as a choice between Trump's agenda and Democratic obstruction. The "Mr Veto" remark from the same interview fits that framing, and the pardon pledge extends it: a Democratic Congress, in Trump's telling, would not merely block legislation but pursue his people, and he would answer with the tools of the presidency. Whether voters hear that as protection or as overreach is a question Tuesday's results may help answer.

Why It Matters

The pledge matters for three reasons. First, it raises the stakes of the House result. If Democrats win the House, they will control committees, subpoenas and hearings, and they will be able to investigate the Department of Government Efficiency, federal contracts and other parts of Trump's second term in public. A preemptive pardon promise tells those investigators, in advance, that their work may be blunted by presidential clemency. That changes the politics of any investigation before it begins.

Second, it tests the idea of preemptive pardons itself. Biden's 2025 pardons were defended as protection against politically motivated prosecution, and criticised as a departure from the normal use of clemency after conviction. Trump is now adopting the same logic for his own allies, which could normalise preemptive pardons as a routine tool of presidential self-protection. Future presidents, of either party, may point to both Biden and Trump when they consider shielding their own teams.

Third, it puts Musk's political spending and government role back at the centre of the campaign's final day. Musk is not on the ballot, but his $474 million in 2026 Republican spending, his Department of Government Efficiency work and his companies' federal business make him a symbol of the alliance between Trump and the tech billionaires who backed him. A promise to pardon him, even conditionally, reinforces that alliance in public, one day before voters decide whether to reward or punish it.

What Happens Next

The immediate next step is the election itself. Voters go to the polls on Tuesday, November 3, with a record 54 million early ballots already cast. If Democrats win the House, as polls suggest they are favoured to do, they will take the gavel in January and gain the committee chairs who decide what gets investigated. Any pardon decision by Trump would then be judged against the actual investigations that follow, not the hypothetical ones discussed in a podcast.

If Republicans hold the House, the pardon pledge may never be tested. House committees would remain in Republican hands, and the threat of Democratic investigations that prompted the question would recede. In that case, the interview remark would stand as campaign rhetoric rather than as a prelude to clemency action.

Either way, the legal limits will shape what happens next. A pardon, if issued, would need to specify the federal offences it covers, and it would not shield anyone from state charges or civil claims. Legal challenges to preemptive pardons have been debated for decades, and any pardon for Musk or his aides would likely be examined closely by lawyers and commentators, even if its validity under the pardon power is broadly accepted.

Watch also for any response from Musk himself, and from the White House, in the hours after the interview's publication. As of Monday's reports, the story rested on Trump's own words in the podcast, not on a formal White House statement or a pardon proclamation. That distinction matters: a podcast pledge is a political signal, while a signed pardon is a legal act. The gap between the two is where this story will either grow or fade after Election Day.

Frequently Asked Questions

What did Trump actually say about pardoning Musk?
He said he would protect Musk and his aides if Democrats investigated them, and that he would issue preemptive pardons "if I needed to", adding: "I wouldn't even think about it. I did it for J6."

Has Trump pardoned Musk?
No. The remarks are a conditional pledge for the future, tied to Democrats winning Congress and pursuing investigations. No pardon proclamation for Musk was reported on Monday.

Why would Democrats investigate Musk?
Democrats have signalled possible inquiries into his Department of Government Efficiency work, his companies' federal contracts and Starlink's role in Ukraine's satellite access. No criminal charge against Musk was mentioned in the interview reports.

What is a preemptive pardon?
It is a pardon granted before any charge is brought, shielding the recipient from federal prosecution for specified conduct. Joe Biden issued such pardons in January 2025 to officials and family members he expected could face retaliation.

Would a pardon stop all legal action against Musk?
No. Presidential pardons cover federal offences only. They do not prevent state prosecutions, civil lawsuits or impeachment proceedings.
