A federal judge has blocked Afghan deportations to Afghanistan or Pakistan through November 7, grounding a planned Election Day flight expected to carry about 150 Afghans from Louisiana to Pakistan and onward to Taliban-controlled Afghanistan. United States District Judge Valerie Caproni of the Southern District of New York issued the order on Tuesday, November 3, 2026.

It puts a court-backed hold on it for the rest of the week and forces the government to answer the challenge by November 5. Many of those affected arrived after the 2021 United States withdrawal, or are relatives of Afghans who worked alongside American forces.

Key Points

• Judge Valerie Caproni barred deportations of Afghan nationals to Afghanistan or Pakistan through November 7, 2026.
• The blocked flight was due to leave Alexandria, Louisiana, at about 7 p.m. on Election Day, November 3, with some 150 Afghans.
• Advocates said passengers would be bused across the Pakistan border and handed to the Taliban's intelligence service.
• A government lawyer relayed an ICE official's word that there were "no planned or confirmed" Afghan flights this week.
• The reprieve may be brief: the plan has not been withdrawn, and some detainees were told a flight could leave in a week or two.

What Happened

Lawyers challenging the plan appeared in a Manhattan courtroom on Tuesday, hours before the flight was due to depart. A government lawyer relayed the word of a senior Immigration and Customs Enforcement (ICE) official that the agency had "no planned or confirmed chartered or commercial flights" for Afghans this week, and that arranging such flights takes weeks. Judge Caproni recorded that promise in her order, writing that the government "has effectively represented that no Afghanistan nationals will be deported from the United States to Afghanistan or Pakistan this week".

The flight was scheduled to leave Alexandria, Louisiana, at around 7 p.m. on Election Day. Shawn VanDiver, president and founder of #AfghanEvac, said the roughly 150 Afghans on board would have been loaded onto buses in Pakistan, driven through the border gate and delivered to the Taliban's intelligence service. The Department of Homeland Security (DHS) says it does not comment on prospective removal operations.

That position contrasted with earlier government filings. ICE officials and prosecutors told courts in Texas and Oklahoma last month that Afghan detainees were scheduled for a flight in the first week of November. An ICE supervisor in Virginia swore its destination would be Pakistan, "with further transport onward to Afghanistan".

Background and Context

Reports of a plan to deport more than 150 Afghans, many detained in Louisiana, first emerged on October 30 and 31, with the first flight expected as early as November 2. The United States has no diplomatic relations with the Taliban government, so Pakistan was identified as the transit route. Temporary Protected Status for Afghanistan was terminated on July 14, 2025, affecting about 11,700 people, and Pakistan has expelled more than two million Afghans since 2023.

On November 2, 66 bicameral members of Congress, led by Representative Scott Peters of California, wrote to Secretary of State Marco Rubio and Homeland Security Secretary Markwayne Mullin demanding immediate cancellation of the flights. They warned that sending people back to what they called "one of the most dangerous countries on earth" would amount to "a death sentence", noting Afghanistan's Level 4 travel warning. Human Rights First had separately confirmed that a Tuesday flight from Alexandria to Pakistan was scheduled.

Afghan Deportation Flight Blocked: What the Order Does and Does Not Do

The order bars deportations of Afghan nationals to Afghanistan or Pakistan through November 7, and holds the government to its courtroom promise that no such flight is planned this week. That is real, immediate protection for the people due to board on Tuesday evening. It is not a final ruling on whether the plan itself is lawful, and it does not withdraw the plan.

Advocates warn the danger has been postponed, not removed. If the reported timetable of a flight in a week or two holds, the next test will come almost immediately after the November 7 bar expires, unless a further order extends it. What the government says on November 5 will shape whether the court extends the protection, narrows it, or lets it lapse.

Reactions and Quotes

Advocates for Afghan evacuees called the order a vital, if temporary, lifeline. VanDiver's account of the planned journey, from a Louisiana departure to buses at the Pakistan border and delivery to the Taliban's intelligence service, is the starkest public description of what the flight would have meant.

The administration's public position has stayed guarded. DHS declined to confirm future operations, and in court its lawyer emphasised the ICE assurance that no Afghan flights were planned or confirmed for this week. The Taliban-led Afghan Foreign Ministry said on Monday it was prepared to engage constructively on returns, a statement that did little to reassure critics.

Why It Matters

The case goes to the heart of America's unfinished obligation to Afghans who sided with the United States during twenty years of war. More than 120,000 people were evacuated in 2021, but tens of thousands more were left behind or arrived since through parole, asylum and temporary protections. For those whose claims have since been denied, the question is whether the country they would be sent to is safe enough for return at all.

The would-be passengers illustrate those stakes. They included women, LGBTQ+ people and religious and ethnic minorities, groups facing particular risk under Taliban rule. At least one man served alongside American troops, and about 15 others had relatives who did. The case is also a test of judicial oversight: if courts cannot hold the government to clear, consistent accounts of imminent flights, emergency challenges become almost impossible to bring in time.

What Happens Next

The government's response is due November 5, and the bar runs through November 7. Either date could bring a ruling extending, modifying or ending the protection. Lawyers for the detainees are expected to press for a longer injunction, while the government may argue the case is now moot for this week.

For the detainees, the coming days are uncertain. A flight said to be a week or two away could still depart shortly after the bar lifts, unless litigation or political pressure changes the plan.
