Republican Representative Max Miller has lost re-election in Ohio's 7th Congressional District to Democratic challenger Brian Poindexter, a union ironworker backed by Senator Bernie Sanders, in one of the sharpest upsets of the 2026 midterm elections. Poindexter led 54% to 46% as of midnight on election night, with NBC News and Decision Desk putting the margin at 54.1% to 45.9%. The result flips a seat that former President Donald Trump carried by 11 points in 2024 and that Miller had won by almost 15 points for his second term.

The Max Miller Ohio House race became one of the most closely watched contests in the country not because of policy alone, but because a bitter custody battle and abuse allegations against Miller dominated the final months of the campaign. Miller denies the allegations, has sued his former wife for defamation, and has not been charged with a crime. Voters delivered a decisive verdict on Tuesday, November 3, 2026.

Key Points

• Democrat Brian Poindexter defeated Republican incumbent Max Miller in Ohio's 7th District, 54% to 46%.
• The district backed Donald Trump by 11 points in 2024; Miller had previously won the seat by almost 15 points.
• Miller's campaign was overshadowed by a custody dispute with his ex-wife Emily Moreno, daughter of Senator Bernie Moreno.
• Miller denies allegations of physical abuse, has not been charged, and is suing Moreno for defamation.
• A Cuyahoga County prosecutor found insufficient admissible evidence to take the daughter's case to a grand jury.

What Happened

On Tuesday, November 3, 2026, voters in Ohio's 7th Congressional District chose Poindexter over the two-term incumbent. Early returns showed a clear lead for the challenger, and by midnight the margin stood at eight points, 54% to 46%. Election analysts NBC News and Decision Desk later reported a near-identical split of 54.1% to 45.9%.

Poindexter ran with the backing of Senator Bernie Sanders and presented himself as a working-class alternative to the incumbent. For Miller, the defeat ends a congressional career that began with his first election to the House and continued through a second term won comfortably.

Background and Context

Ohio's 7th District covers communities in northeast Ohio, including parts of the Cleveland area, and has long been regarded as Republican-leaning territory. Miller, a former aide to President Trump, built his political identity around loyalty to the former president and conservative positions in Congress.

That profile was tested long before polling day by a personal and legal dispute that became impossible to separate from the campaign. Miller's ex-wife, Emily Moreno, is the daughter of Republican Senator Bernie Moreno of Ohio. In divorce proceedings, Moreno alleged that Miller physically abused her, including holding a gun to her head and scalding her with hot water, and that their two-year-old daughter suffered a broken collarbone.

Those allegations have not resulted in criminal charges against Miller. A Cuyahoga County prosecutor found insufficient admissible evidence to take the case involving the daughter to a grand jury, and a court-appointed parental coordinator said she was not convinced that Miller abused his wife and daughter. Miller has consistently denied the allegations and has sued Moreno for defamation.

The dispute also spilled into Republican politics itself. Senator Bernie Moreno publicly urged Miller to drop out of the race before the early-August deadline, calling him, in Moreno's words, "a danger to my daughter." The intervention signalled that Miller's standing within his own party had collapsed.

Max Miller Ohio House Race: Why the Seat Flipped

The Max Miller Ohio House race turned on character and trust as much as on party labels. Poindexter's campaign focused on working families, union jobs and everyday costs, while Miller's opponents repeatedly returned to the custody case and the questions it raised about his conduct. Republican support for Miller also thinned in visible ways, and his absence from a Trump tele-rally for Ohio candidates in the final days of the campaign had already drawn attention.

In a district where Republican voters might normally have rallied behind an incumbent, many appear instead to have stayed home, switched sides, or voted for the challenger. The result also fits the wider pattern of the 2026 midterms, in which Democrats made gains in suburban and working-class districts alike. Poindexter's union background gave him credibility on jobs and wages, and his margin suggests he won support well beyond the Democratic base.

Reactions and Statements

Senator Bernie Moreno's call for Miller to withdraw was the most direct statement of the campaign. Moreno said publicly that Miller was "a danger to my daughter" and urged him to drop out before the early-August deadline. Miller did not withdraw and continued his campaign to election day.

Miller has denied the abuse allegations throughout. He has sued Moreno for defamation over the claims and has pointed to the absence of criminal charges. The House Ethics Committee review of domestic-violence and drug-use allegations against Miller remains open, according to reporting on the race. No detailed concession statement from Miller was in the first election-night reports.

Why It Matters

The loss matters for three reasons. First, it removes a Trump-aligned incumbent from a seat Republicans expected to hold, narrowing the party's path in the House. Second, it shows how a personal scandal, even without criminal charges, can overwhelm incumbency and party advantage when it is litigated in public and within the candidate's own party. Third, it underlines the scale of the Democratic midterm advance: flipping a district Trump carried by 11 points requires persuading a substantial number of voters who previously backed Republicans, and that kind of swing, repeated in other districts, is what turns a midterm into a wave.

What Happens Next

Miller and Moreno's custody trial is scheduled to begin on Thursday, November 5, in Cuyahoga County Domestic Relations Court, where both seek sole custody of their child. That trial will now take place after Miller has lost his seat, and it may bring further public attention to the dispute that defined his campaign. Poindexter will take his seat in the new Congress in January 2027, joining a Democratic House majority.

Republicans, meanwhile, will have to reckon with a seat lost not to redistricting or a national tide alone, but to a candidate whose own party's senior senator in the state publicly opposed him. That lesson is likely to shape candidate selection in Ohio and beyond before the next election cycle.
