Abortion rights prevailed in three of the four states that put the issue directly to voters in the 2026 midterm elections, with Nevada and Virginia approving constitutional protections, Missouri rejecting an attempt to repeal its existing abortion rights amendment, and Idaho rejecting a measure that would have lifted its near-total ban. The results, from voting on Tuesday, November 3, 2026, showed that even in a midterm cycle dominated by the economy and control of Congress, abortion remained a powerful ballot-box issue where voters were asked to decide it themselves, four years after the Supreme Court ended the federal constitutional right to abortion.

Key Points

• Virginia Question 1 passed with about 62 percent, creating a constitutional right to reproductive freedom, including abortion in the first two trimesters.
• Nevada Question 6 passed with about 63 percent, its second consecutive general-election victory, required for a citizen-initiated amendment to take effect.
• Missouri voters rejected Amendment 3 by 55.5 percent to 44.5 percent, leaving the abortion rights amendment approved in 2024 in place.
• Idaho Proposition 1 failed with about 44 percent, so the state's near-total abortion ban remains in force.
• Abortion rights were strengthened or preserved in three states, while access remains heavily restricted in Idaho.

What Happened

In Virginia, Question 1 asked voters whether to add a constitutional right to reproductive freedom, covering abortion in the first two trimesters, with later abortions permitted when the patient's health is at risk or the pregnancy cannot survive. With about 96 percent counted, it passed with roughly 62 to 62.4 percent. The amendment takes effect on January 1, 2027.

In Nevada, Question 6 asked voters to establish a constitutional right to abortion until fetal viability, and afterward to protect the life or health of the patient. It passed with about 63 to 63.3 percent, with about 85 percent counted. The second victory matters procedurally as well as politically: Nevada requires citizen-initiated amendments to pass in two consecutive general elections, and Question 6 had already passed in 2024 with 64.4 percent. Tuesday's result completes that process and locks the protection into the state constitution.

In Missouri, the question was reversed. Voters in 2024 had approved an abortion rights amendment by a narrow margin. Amendment 3 in 2026 would have replaced it with a ban, allowing abortion only in medical emergencies, in cases of fatal fetal anomalies, and in cases of rape or incest before 12 weeks. With about 98.5 percent counted, voters rejected that replacement by 55.5 percent to 44.5 percent, so abortion remains legal in Missouri under the 2024 amendment.

In Idaho, Proposition 1 would have ended the near-total ban and allowed abortion until viability. It failed with about 44 percent, with about 96.5 percent counted. Idaho's ban, which permits abortion only in very narrow circumstances, therefore remains in place, leaving Idaho among the most restrictive states on abortion access.

Background/Context

The four measures share a common origin: the Supreme Court's 2022 decision in Dobbs v. Jackson Women's Health Organization, which overturned Roe v. Wade and returned abortion regulation to the states. Since then, policy has diverged sharply. Some states have written protections into their constitutions, some have enacted near-total bans, and several have asked voters to settle the question directly rather than leaving it entirely to legislatures.

Abortion Rights 2026 Midterm Results

The margins in the three states where abortion rights prevailed were consistent. Virginia's roughly 62 percent was a clear majority, not a narrow win, with almost all votes counted. Nevada's roughly 63 percent was in line with its 2024 result of 64.4 percent, suggesting stable support across two cycles rather than a one-year surge. Missouri's 55.5 percent against repeal was narrower, but still a majority voting to keep the 2024 amendment, with nearly all votes counted.

Idaho was the exception, and the size of the gap matters. At about 44 percent, Proposition 1 fell well short of a majority, indicating voters there were not ready to move from a near-total ban to a viability standard.

The results also sit alongside the broader set of 2026 midterm ballot measures, in which voters decided 145 questions across more than three dozen states.

Reactions/Quotes

Supporters of abortion rights treated the night as validation of taking the issue directly to voters. In Virginia, reproductive freedom will be constitutionally protected from January 2027 rather than depending on future legislatures. In Nevada, the second passage completes a process begun in 2024 and gives the protection constitutional permanence. In Missouri, the defeat of Amendment 3 means the 2024 amendment survives a direct attempt to replace it, which supporters will present as evidence that the earlier vote was not an anomaly.

Why It Matters

The results matter for three reasons. First, constitutional amendments are harder to reverse than ordinary statutes: Virginia and Nevada have placed protections in their constitutions, and Missouri has preserved one. Second, they give a fresh, state-by-state picture of voter opinion in 2026, as Congress, legislatures and courts continue to shape the post-Dobbs landscape. Third, Idaho is a reminder that the national picture is not uniform, and the gap between the most protective and most restrictive states continues to widen.

What Happens Next

In Virginia, officials will prepare for Question 1 to take effect on January 1, 2027, and health providers will adjust guidance to reflect the new constitutional language. In Nevada, the amendment process is finished and the protection is now part of the constitution. In Missouri, the 2024 amendment remains the governing law, and attention turns to how the legislature and courts interpret it. In Idaho, the ban remains in force, and focus returns to ongoing court cases over its exceptions and to whether supporters of broader access will try a different measure in a future cycle. Nationally, both sides will study Tuesday's margins to decide where to run, defend or retry measures next.

Frequently Asked Questions

Which states voted on abortion in the 2026 midterms?

Nevada, Virginia, Missouri and Idaho all put abortion measures on the ballot on November 3, 2026. Abortion rights prevailed in Nevada, Virginia and Missouri, while Idaho voters rejected a measure to lift the near-total ban.

What did Virginia Question 1 do?

It creates a constitutional right to reproductive freedom, including abortion in the first two trimesters, with later abortions allowed when the patient's health is at risk or the pregnancy cannot survive. It takes effect on January 1, 2027.

Why did Nevada need to pass Question 6 twice?

Nevada requires citizen-initiated constitutional amendments to pass in two consecutive general elections. Question 6 passed in 2024 with 64.4 percent and again in 2026 with about 63 percent, completing that process.

What happened in Missouri?

Voters rejected Amendment 3 by 55.5 percent to 44.5 percent. It would have replaced the 2024 abortion rights amendment with a ban subject to limited exceptions, so abortion remains legal in Missouri under the 2024 amendment.

What happened in Idaho?

Proposition 1, which would have ended the near-total ban and allowed abortion until viability, failed with about 44 percent. Idaho's near-total ban remains in force.
