More than 500 American citizens have been detained by immigration agents, according to a ProPublica investigation published on November 2, 2026. The news organisation says its tally is almost certainly an undercount. Forty House Democrats have demanded answers from the Department of Homeland Security.

Key Points

• ProPublica documented more than 500 cases of US citizens detained by immigration agents, including roughly a dozen deported, most of them children.
• More than 100 Americans were questioned about their citizenship, 63 were detained while recording encounters with agents, and 36 were held at least a day without contacting a lawyer or family.
• Forty House Democrats, led by Lou Correa and Pramila Jayapal, wrote to Secretary Markwayne Mullin in October demanding the number of citizens detained and details of how such encounters are tracked.
• The Department of Homeland Security has long insisted it is not arresting US citizens and has defended its operations as “highly targeted.”
• Representative Teresa Leger Fernández has introduced a bill to make it easier for citizens to sue immigration agents over wrongful arrests.

What Happened

ProPublica built its tally from court records, news reports and interviews, and found more than 500 US citizens detained by immigration agents. The organisation said the true figure is likely far higher, because the government keeps no public count of citizens caught up in immigration enforcement and many cases never surface publicly.

More than 100 Americans were stopped and questioned about their citizenship. Sixty-three were detained while recording their interactions with agents. Thirty-six were held for at least a day without contacting a lawyer or a family member. Roughly a dozen citizens were deported, most of them children, raising serious questions about how agents verify citizenship before taking someone into custody. Democrats have pressed the administration for details on these encounters since early 2025, with little public response.

Background: An Enforcement Push With Little Public Accounting

Immigration enforcement has intensified sharply under the Trump administration, with agents carrying out large-scale operations in cities across the country. The administration says the campaign focuses on people in the country illegally, particularly those with criminal records, and that its operations are targeted and lawful.

But the ProPublica findings add to growing reporting that citizens are being caught in the dragnet. Earlier reporting has documented citizens detained during workplace raids, and lawmakers worry agents rely on appearance or accent. The department publishes no data on citizen detentions, so Congress cannot judge how often mistakes happen. The issue has already caused friction inside the administration: as US News Pulse has reported, President Donald Trump told aides that Stephen Miller had gone too far on deportations.

US Citizens Detained by ICE: What the Numbers Show

The central finding is the scale: more than 500 US citizens detained, with the organisation warning the real number is almost certainly higher. The cases span the country and include people detained for hours or days, and children deported with family members.

The pattern is what alarms lawmakers most. Citizens were questioned about their status, detained while filming agents, and in dozens of cases held at least a day without a lawyer or family. For a citizen, even a brief detention can mean a lost job, a missed court date or a child left without a parent. For the roughly dozen citizens deported, most of them children, the consequences were far more severe, and reversing a wrongful deportation is slow. Because the department does not track citizens detained by its agents, there is no official baseline to measure the problem.

Reactions and Quotes

The forty House Democrats who wrote to Secretary Mullin in October, led by Representatives Lou Correa and Pramila Jayapal, asked for the number of citizens detained, how the department tracks such encounters, and details of agent training on verifying citizenship. They warned the actions may violate citizens’ rights to due process and equal protection.

Representative Teresa Leger Fernández of New Mexico has gone further, introducing the Justice for Citizens Wrongfully Detained by ICE Act last month. The bill would make it easier for citizens to sue immigration agents for wrongful arrests, giving wrongly detained people a clearer path to compensation and accountability. The Department of Homeland Security has long insisted it is not arresting US citizens and has defended its operations as “highly targeted.” It has not released its own figures, and it did not immediately provide the data the House Democrats requested. Democrats have also pressed the administration on other deportation operations, including planned Afghan deportation flights via Pakistan.

Why It Matters

Detaining a US citizen is not a paperwork error. Citizens have a constitutional right to due process and equal protection, and those rights do not depend on an agent’s judgment in the moment. When the government cannot say how many citizens it has detained, it cannot say whether the problem is rare or routine, or show the public it is fixing it. The deportation of citizens, most of them children, is the sharpest edge: a citizen child removed from the country loses schooling, healthcare and family stability, and returning them requires legal action many families cannot afford

What Happens Next

The House Democrats’ letter puts the Department of Homeland Security on the clock to produce figures on citizen detentions, its tracking methods and its agent training. Whether it answers in full will test how the administration handles congressional oversight on immigration. Democrats, who won both chambers on November 3 and take control in January 2027, will have subpoena power to press for the data.

Representative Leger Fernández’s bill will also be watched closely. Its prospects depend on the new Congress, but even if it does not pass, it frames the debate over whether wrongly detained citizens should have a straightforward right to sue. ProPublica’s investigation is meanwhile likely to prompt further reporting and lawsuits.

Frequently Asked Questions

How many US citizens have immigration agents detained?

ProPublica documented more than 500 cases, including more than 100 Americans questioned about their citizenship, 63 detained while recording encounters, 36 held at least a day without access to a lawyer or family, and roughly a dozen citizens deported, mostly children. The organisation says the true total is almost certainly higher.

Can immigration agents legally detain a US citizen?

No. US citizens cannot lawfully be detained or deported under immigration law. When a citizen is detained, it is a mistake or a violation of their rights.

Why does the government not have an exact count?

The Department of Homeland Security does not transparently track cases in which its agents detain US citizens, so there is no official public figure. ProPublica built its tally from court records, news reports, interviews and public records.

What are Democrats asking the Department of Homeland Security to provide?

The forty House Democrats asked Secretary Markwayne Mullin for the number of citizens detained, an explanation of how the department tracks such encounters, and details of agent training on verifying citizenship and legal status.

What would the Justice for Citizens Wrongfully Detained by ICE Act do?

Introduced by Representative Teresa Leger Fernández, the bill would make it easier for US citizens to sue immigration agents for wrongful arrests, giving wrongly detained citizens a clearer route to compensation and accountability.
